1. Acceptance of Terms

Welcome to CalTrako. By downloading, installing, or using the CalTrako mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Elated Studio ("we," "us," or "our").

2. Description of Service

CalTrako is a calorie tracking application that allows users to:

• Log daily calorie intake
• Set and monitor calorie goals
• Sync data across multiple devices
• Track nutrition and fitness progress
• Access food database for nutritional information

3. User Accounts

3.1 Account Creation

To use certain features of CalTrako, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 13 years old to create an account. If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the App.

4. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Use the App to harass, abuse, or harm another person
• Impersonate any person or entity
• Transmit viruses, malware, or malicious code
• Scrape, spider, or crawl the App
• Reverse engineer or attempt to extract source code

5. Medical Disclaimer

• The App provides general calorie tracking for informational purposes only
• Nutritional information may not be 100% accurate
• Consult a healthcare professional before starting any diet or nutrition program
• Do not rely solely on the App for medical decisions
• If you have any health concerns, seek professional medical advice
• We are not responsible for any health outcomes resulting from App use

6. Intellectual Property

6.1 Our Rights

The App, including its design, features, content, and functionality, is owned by Elated Studio and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Rights

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

6.3 Your Content

You retain ownership of the data you input into the App (your calorie logs, goals, etc.). By using the App, you grant us a license to store, process, and display your content to provide the service.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

Key points:

• We do not sell your personal data
• Your data is encrypted and securely stored
• You can export or delete your data at any time
• We use third-party services (Supabase, FatSecret) to operate the App

8. Free Service

CalTrako is currently provided free of charge. We reserve the right to:

• Introduce paid features or subscriptions in the future
• Modify or discontinue any feature
• Change pricing (with advance notice to existing users)

Existing users will be notified of any significant changes 30 days in advance.

9. Termination

9.1 By You

You may terminate your account at any time by:

• Using the account deletion feature in the App
• Contacting us at support@elatedstudio.com

9.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• Required by law
• The App is discontinued

10. Disclaimers and Limitations of Liability

10.1 "AS IS" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELATED STUDIO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Health issues arising from use of the App
• Inaccuracies in nutritional information
• Interruption or cessation of the service

11. Indemnification

You agree to indemnify and hold harmless Elated Studio from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on this page
• Updating the "Last Updated" date
• Sending an in-app notification

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiations between you and us
2. Mediation, if negotiations fail
3. Arbitration or courts in Chennai, India

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elated Studio regarding the use of CalTrako.
